With the signing of Senate Bill 269, businesses gain extra protection from construction related ADA lawsuits. This new bill grants businesses 120 days from the date of a CASp inspection to remove the architectural barriers found in the report. During this 120 days, the business owner will not be responsible for any fines from the governing agency or from a lawsuit. Previous law only reduced the fines from $4,000 to $1,000 per infraction.
With construction related ADA lawsuits continuing to rise in California, this new bill is a great victory for the business community.
